Inspection fees

In pursuance of the provisions of clause(3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of Notification No. MPP-A(4)5/91 dated 15-10-1992.

MULTIPURPOSE PROJECTS AND POWER DEPARTMENT

NOTIFICATION

No. M.P.P.-A(4)-5/91.- In Partial Modification of Government notifications No. MPP-A(4)-8/74 dated 15th October, 1992 and in exercise of the powers conferred under sub-rule (2) of rule 7 read with sub-rule 2 of rule 46, of Indian Electricity Rules, 1956 the Governor, Himachal Pradesh is pleased to make the following orders to regulate the levy of fees for initial or periodical testing and inspection and generally for the services of Chief Electrical Inspector to the Government of Himachal Pradesh or HPSEBL as the case may be:-

THE HIMACHAL PRADESH LEVY OF FEES FOR TESTING AND INSPECTION ORDER, 1992.

  1. Short title:- This order may be called the Himachal Pradesh Levy of Fees for Testing and Inspection Order, 1992.
  2. Definitions:- In this order the terms and expressions used shall have the same meanings as they have in the Indian Electricity Act, 1910 and the Indian Electricity Rules, 1956 except that for the purpose of this order:-
    • “Chief Electrical Inspector” means an Electrical Inspector appointed under section 162 of the Electricity Act, 2003.
    • “initial” with reference to the inspection, examination or test of any electrical installation or apparatus shall mean the first inspection carried out by the Chief Electrical Inspector or any Officer appointed to assist him or HPSEBL, either before or after its being brought into use, or its connection after having being without supply for a period of 6 months or more and shall include the first inspection, examination or test necessitated as a result of an extension or alteration in the existing installation except these carried out under the instructions of the Chief Electrical Inspector of his authorized representative with the sole purpose of rectifying a defective installation already inspected by the said inspector or his authorized representative or HPSEBL.
    • “licensee” shall include the State Electricity Board and also a person engaged in the business of supply energy with the sanction of the Government obtained under sub-section (1) of section 28 of the Indian Electricity Act, 1910;
    • “owner” means a licensee and shall include an occupier of any building, place, carriage or vessel in which energy is, or is about to the generated, received or used;
    • “periodical” with reference to the inspection, examination or test of any electrical installation or apparatus shall mean the inspection or test carried out in pursuance of rule 46 of the Indian Electricity Rules, 1956; and
    • “subsequent” with reference to the inspection, examination or test of any electrical installation or apparatus shall mean the inspection or test necessitated due to the installation or apparatus having been found to contravene the relevant requirement of Indian Electricity Rules, 1956 during an initial or any other inspection.
  3. Periodical Inspection:- Every installation already connected to the supply system of the supplier shall be inspected and tested once in every five years by:-
    • The Chief Electrical Inspector or any other officer appointed to assist him in the case of high pressure installations; and
    • The supplier in the case of medium and low pressure installations: Provided that a re-inspection may be carried out during the said period to ensure that any direction or order given to the owner as a result of inspection has been carried out or not.
  4. Fees:- Subject to the following conditions fees shall be levied for testing and inspection (including periodical inspections) and generally for the services of Chief Electrical Inspector or any other officer appointed to assist him or HPSEBL as the case may be, shall be realized from the person and in accordance with the scales specified in the Schedule-
    • In the case of any inspection examination or test specified in scales “A” to “B” no fee shall be levied for a second or subsequent inspection, examination or test made within a period of twelve months from the date of a similar inspection, examination or test for which prescribed fee has been paid unless such further inspection, examination or test is made on application or in pursuance of Para 3 above or is necessary as a result of an extension or alteration of the installation or is in the opinion, which will be recorded in writing, of the Chief Electrical Inspector necessitated by a breach of any of the provisions of the Act or of the rules made thereunder or by the neglect or failure of the licensee or owner to carry out, within stipulated time, any written order of Chief Electrical Inspector or any other officer appointed to assist him.
    • The fee for subsequent inspection or test of an installation is necessitated as a result of detection of defects during initial or any other inspection will be equal to the fee prescribed under scale “A” to “B”.
  5. Payment of fee and other charges.-
    • The fee payable under this order shall be paid in the Government treasury in advance under appropriate head of account as may be prescribed by the State Government from time to time.
    • The Fee in case of initial as well as periodical inspections of medium voltage consumer installations shall be realized by HPSEBL.
    • The fee shall be paid by the owner of the installation excluding non-commercial department of the State Government except where provided otherwise.
    • The transport from divisional headquarter of Himachal Pradesh State Electricity Board to the site of work or its actual cost, shall be provided by the supplier or owner as the case may be.

SCHEDULE OF FEES

SCALE “A”

For an inspection, examination or test of an Electrical Installation or apparatus to which energy is, or is about to be supplied at medium or high pressure except in cases to which scale “B” to “P” specifically apply:-

SCALE “D”

For an inspection, examination or test of :-

1 a high voltage service connection 400/-
2 a medium voltage service connection 200/-
3 a low voltage service connection 200/-

SCALE “E”

For an inspection or examination of every new aerial line including a service line, passing either, above or below a telegraph/telephone or other aerial line at one or more spans/places or points. 100/-
  1. N.B.- The fee livable under this scale shall not be charged when the inspection has been carried out in connection with an inspection for which fee is levied under scale “D” or “F”.
  2. The fee shall be paid by the person(s) whose line was last erected.

SCALE “F”

1. For initial or periodical inspection or examination of aerial line or under-ground cable upto and including 33000 Volts:

1 Upto and including 1 KM 200/-
2 Every additional length of 1 KM or part thereof 50/-
3 Every alteration or replacement in the line 300/-

2.For initial or periodical inspection and examination of extra a high tension line or cable - Rs.300/-

For 1 km Rs. 100/- for Every additional length of 1 km or part hereof.

SCALE “G”

For an inspection and/or issue of certificate Rs. 300/- under sub-rule (3) of rule 82 of Indian Electricity Rules, 1956.

Note:- The fee shall be paid by the person who purposes either to erect a new building or a structure or to make any temporary addition or alteration in or upon any building or a structure which during or after construction would result in the contravention of the provisions of rules 79 or 80 of the Indian Electricity Rules, 1956.

SCALE “H”

For an inspection or examination of any Rs. 300/- per electric traction system, trolley wires and diem of 8 overhead equipment and test of bonding hours and/or leakage currents

SCALE “I”

For testing of energy meters of every capacity :-

1 for testing single phase meters of every capacity 50/-
2 for testing poly phase meters of any capacity but without CT’s 100/-
3 for testing of HT or special meter (Maximum Demand Indicator,Trivecto meter). 150/-

N.B.:-

  1. If a meter is to be tested on the consumer premises actual amount of the transportation charges plus above fees prescribed in clauses (i) (ii) and (iii) shall be charged.
  2. The testing charges in respect of such meters/ metering equipment which are not covered here will be the same as charged/notified by the Himachal Pradesh State Electricity Board for such testing.
  3. The fee shall be paid by the owner of the meter.

SCALE “J”

For an inspection, examination or test of any main, distributing mains or service line for the existence of electrolysis or other injury to any water gas or to any appliance connected therewith. Rs. 100/- for the first hour or part and there after Rs. 50/- per hour or part thereof plus other pipe or cost of transportation.

N.B.-

  1. If any leakage is discovered in any such main, distributing main or service line, the fee shall be paid by the licensee or the owner of the main, distributing main or service line as the case may be.
  2. If no leakage is discovered the fee shall be paid by the owner of the water, gas or other pipe or of the appliance connected therewith.

SCALE “K”

For the testing of installation for leakage to earth. Rs. 50/- per hour subject to maximum of Rs. 200/- plus the cost of transportation.

Note.- The fee shall be paid by the party making application or from the owner of the electrical installation when the leakage exceeds the permissible limit.

SCALE “L”

For localizing the leakage to earth in any installations. Rs. 50/- for the first hour and part thereof and thereafter Rs. 20/- per hour plus cost or transportation.

Note.- The fee shall be paid by the party making the application.

SCALE “M”

Where the Chief Electrical Inspector is called upon to settle any dispute arising under :-

Sub section (4) of section (21) of the Indian Electricity Act, 1910 of the sub-section (4), (6) and (7) of section (26) of the Act. Rs. 500/- per decision subject to note 2 below.
Clause VI (3) of the Schedule of the Indian Electricity Act, 1910. Rs. 500/- per decision subject to note 2 below.

Proviso to sub-rule (2) of the rule 82 of the Indian Electricity Rules, 1956

N.B.-

  1. The fee shall be paid in advance by the party referring dispute but will be borne finally by the party against whom the decision is given.
  2. If inspection of the site is involved for decision, the party referring the dispute shall have to pay in advance the charges of the inspecting officer or transport from office to site and beck will have to be arranged for the inspecting officer.
  3. For any case of dispute referred to the Chief Electrical Inspector, arbitration fee from ach party in the dispute shall be 5% of the disputed amount, subject to minimum of Rs. 1000/- and maximum of Rs. 7500/-

SCALE “N”

(i) For testing of installation in pursuance of sub-rule - Rs. 100/- (1) of the Rule 52 of Indian Electricity Rules, 1956.

(ii) If inspection of the site is involved for decision the party referring the dispute shall have to pay in advance the T.A. Charges of the inspecting officer or transport from office to site and back will have to be arranged for the inspecting officer.

(iii) The cost of any inspection or test made on the request of consumer shall be borne by the consumer unless directed other under sub-rule (2) of Rule, 53 of Indian Electricity Rules, 1956.

SCALE “O”

For periodical inspection examination or test of a law voltage Installation. Rs. 20/-

SCALE “P”

1 for medical installations Rs. 75/-
2 for others Rs. 150/-

MISCELLANEOUS

For an inspection, examination or test not provided for in any of the foregoing scales Rs. 100/-

or such other fee as the Chief Electrical Inspector may consider reasonable and proper in the circumstances and the cost of transportation.

N.B.-

  1. In cases where fee have already been deposited at the existing rates prior to publication of this notification no additional fee, if any, shall be chargeable even if the inspection is carried out subsequent to this notification.
  2. For the purpose of sub-rule (2) of rule 7 of Indian Electricity Rules, 1956, all the electrical installations, which have not been inspected earlier but have been energised shall be considered as new installation.
